Kirby Estate files appeal in Marvel lawsuit

When I last heard about the ongoing Jack Kirby Estate vs. Disney/Marvel lawsuit, the company had won summary judgements against the estate and appeals were being planned. Today, the estate filed an official notice of appeal to the Second Circuit Court of Appeal.
“We respectfully disagree with the court’s ruling and intend to appeal this matter to the Second Circuit,” the estate’s lawyer Marc Toberoff told The Hollywood Reporter. “Sometimes you have to lose in order to win.”
With the suit, the Kirby Estate is attempting to terminate early copyright grants of more than 45 characters including Captain America, The Fantastic Four, The X-Men, The Avengers, Iron Man, Hulk, The Silver Surfer and Thor . According to THR, the estate sent notices to Marvel not just Marvel but its licensees Sony (Spider-Man), Fox (X-Men), Universal and others.
“Marvel then sued in New York federal court claiming Kirby’s creations were ‘works for hire’ and thus not subject to termination,” wrote THR. “The two sides filed summary judgment motions, and last month the circuit court sided with Marvel, ruling that Kirby created the characters as works for hire.”
Deadline added, “Normally these kinds of lawsuits are run of the mill for Hollywood. But not when they’re litigated by Toberoff, who is the bane of Big Media studios because he has a winning track record.” Needless to say, a win for the Kirby Estate here could potentially impact the Marvel brand irreparably.

Carnage U.S.A.

CARNAGE has brought the psychopathic symbiote back to the Marvel Universe in a big way, much to the chagrin of Spider-Man, Iron Man and more than a few others. While the final issue ships next week on Wednesday, June 22, that’s not the last we’ll see of Carnage—in fact, he’s taking the nation by storm!

Writer Zeb Wells and artist Clayton Crain team up once again to deliver a sequel that will have Carnage heeding Manifest Destiny’s call as he leaves the Big Apple behind and brings some of his trademark misery and mayhem westward to Doverton, Colorado in CARNAGE U.S.A., a new limited series beginning this December.
“One of Clayton and my goals was to bring Cletus back to the Marvel Universe and leave him in a place where he could go forward ‘clean’ and cause havoc in other people’s stories,” says Wells. “About halfway through the series I had dinner with [Senior Editor] Steve Wacker and we decided that maybe those ‘other people’ should be Clayton and I. We thought we had a solid hook for another [series], and when Clayton signed on it was a no-brainer. I would never turn down the opportunity to work with Clayton.”
Those who recall the original arc of NEW AVENGERS from back in 2004 know that Carnage got ripped in half by the omnipotent Sentry amid the outbreak at the Raft super villain prison facility and had been presumed dead for quite some time. While it’s common for a new face to take up the mantle of a fallen hero or villain, Wells believes that no other individual could best capture the storied legacy of Carnage.

“Editorially there was no mandate for Carnage to be Cletus Kasady when he returned, but for me the Carnage symbiote without Cletus Kasady loses a lot of [appeal],” he explains. “I didn’t want to throw away all the history he had with Spidey and start fresh, so I tried to have my cake and eat it too in the first series by suggesting that Cletus was dead and watching the symbiote destroy someone else’s life before they reunited.”
If there’s anything we know about Carnage, it’s that he loves nothing more than to relish in the pain and suffering of innocent civilians caught in the wake of his mindless destruction. But of all the places to satisfy his bloodlust, why travel to Doverton, Colorado? Wells helped to shed some light on the subject:
“As you know, Carnage never does anything without a well thought out plan. Wait, no, that’s Captain America or someone. Anyway, Carnage only does things without a well thought out plan. Okay, except this time. Bear with me. Finding out what drives Cletus to Doverton, Colorado will be part of the fun.”
As the sequel’s title implies, Colorado won’t be the only state to fall victim to Carnage’s unique brand of mayhem. Not one for subtlety, he’ll be blazing a gruesome trail across the United States.
“Carnage’s attack on America is of national concern, so it’s all hands on deck,” promises Wells. “But it’s soon apparent that even the Avengers’ biggest guns are in over their heads, and it falls to a more specialized group to try and take Kasady down. All symbiotes on deck!”

Those that haven’t picked up the CARNAGE limited series need not worry about feeling lost in regards to the events that have already transpired. True, that CARNAGE U.S.A. may be a sequel, but it can be approached as a stand-alone limited series.
“CARNAGE was concerned with returning Cletus to some sort of status quo, albeit a status quo where he has a four-armed dismembered torso of Spider-Man’s Doppelganger as a pet,” recaps Wells. “If you know what Carnage is all about, and a four-armed dismembered torso of Spider-Man’s Doppelganger isn’t outside your comfort zone, you’ll be good to go. That said, there will be fun nods to the first CARNAGE series and a character or two from that story might show up.”

Utimate Spider-Man Animated Series Update

The show will premiere on Disney XD at some unknown point in 2012. You can read all about the unique set up of the summit/writer's room at Marvel.com. The series will function a lot more like a tradition network TV show, with a collaborative writing team, where most animated series are written individually. And that writing team is one heck of a cadre of experience with both Spider-Man, Marvel, and comics in general.

Developed by Activision-owned studio Beenox, Spider-Man: Edge of Time challenges the player to take on the roles of both classic Amazing Spider-Man and Spider-Man 2099 to correct a timestream gone awry and prevent a catastrophic future brought on by the early and untimely death of Peter Parker.

“The first Spider-Man entry by Beenox, Spider-Man™: Shattered Dimension was touted as one of the best Spider-Man games to date from both critics and fans,” said Vicharin Vadakan, Director, Global Brand Management. “Beenox is once again taking a fresh and different approach to bring a high-octane adventure and unexpected story to life in Spider-Man: Edge of Time.”

Spider-Man: Edge of Time is a focused, action-packed adventure set in two connected and evolving timelines, from the contemporary times of the Amazing Spider-Man to the corrupted future world of Spider-Man 2099, against the backdrop of a rich, tightly crafted narrative by acclaimed Marvel veteran Peter David (co-creator of the comic book series Spider-Man 2099).  The game features all-new “cause-and-effect” gameplay, where players will see how the immediate and sometimes unexpected effects of their actions as one Spider-Man changes the timeline of the other Spider-Man.  Spider-Man: Edge of Time is slated for release this fall.
